A legal disclaimer
This Client Service Agreement (the "Agreement") is entered into on [Date] (the "Effective Date") by and between:
1. Here in after referred to as the "Horticulturalist/Gardener" or "Service Provider."
Hereinafter referred to as the "Client."
2. Scope of Services
The Horticulturalist/Gardener agrees to provide gardening services to the Client, which may include but are not limited to:
- Lawn mowing and maintenance.
- Planting, pruning, and trimming.
- Weeding and weed control.
- Fertilization and soil conditioning.
- Pest and disease control.
- Irrigation system maintenance.
- Garden design and landscaping (if applicable).
The specific services to be provided will be agreed upon between the Gardener and the Client for each project or visit.
3. Service Schedule and Payment
- The Gardener and the Client will agree upon the schedule and frequency of services.
- Payment terms, invoice is emailed prior to client for a 20% deposit, deposit is then deducted from invoice that is sent on completion of the job. Payment of said invoice must be done within 24 – 48 hours of being emailed. (this is for large jobs, re-occurring clients exempt)
- If deposit is not paid two days prior to job starting, job will be removed from our schedule until funds received.
- If payment of invoice is not made within 48 hours of being emailed a $15 penalty fee will be applied, after another three days another $15 additional late fee will be applied also.
NDIS clients are exempt from the above payment terms.
If the NDIS do not cover the account provided. The customer is liable for all costs incurred.
4. Client Responsibilities
The Client agrees to:
- Provide clear instructions and access to the garden area.
- Ensure the safety of pets, children, and property during gardening services.
- Communicate any special requests or concerns promptly.
- Pay for services as agreed upon.
5. Cancellation and Rescheduling
- Either party may cancel or reschedule services with no less than 24 hours’ notice.
- We understand life happens; children get sick etc. therefore short notice for unforeseen circumstances is understandable.
- The Gardener reserves the right to charge a cancellation fee for short-notice cancellations.
- A cancellation fee of $25.00 will be applicable for anything lese than 24 hours’ notice.
6. Liability and Insurance
The Horticulturalist/ Gardener agrees to maintain appropriate insurance coverage for liability and property damage. The Client acknowledges that accidents can happen and agrees not to hold the Gardener liable for any injury or damage that may occur during gardening services.
7. Termination
Either party may terminate this Agreement for any reason with written notice to the other party.
This can be done by email. Clients on a rotation basis must give a weeks’ notice prior to next visit.
8. Confidentiality
Both parties agree to keep any confidential information obtained during the services confidential and not to disclose it to third parties.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Adelaide, South Australia.
10. Pet Agreement
The client will provide clear access; no dogs permitted on site in the gardens we are working in.
All dog/pet faeces must be cleaned up prior to our horticulturalists/gardeners attending. If there is faeces present a surcharge of $75.00 will be charged instantly to the invoice. We are there to attend to your gardens not to clean up after your pet.
The above will be charged even if lawns are not being edged/mowed.
10. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings.
11. Amendments
This Agreement may only be amended in writing and signed by both parties.
12. Signatures
By signing below, both parties acknowledge that they have read and understood the terms of this Agreement and agree to be bound by them.
